Federal Court Mandates Freedom of Abrego Garcia from ICE Custody

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since his return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. After his return to the United States to face alien smuggling allegations, he was detained in immigration detention.

In her order, the judge pointed out that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

Context of the Case

The legal challenge involve disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.

Conditions of Release

The judge, who was overseeing his challenge to removal in a Maryland district court, ruled that he must now comply with the terms of his release from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
